           WE COMMAND YOU that, all business and excuses being laid aside, you appear and attend before a notary public qualified to administer oaths for your deposition upon oral examination at the offices of the undersigned at 1585 Broadway, New York, NY 10036 on November 12, 2002 at 10:00 a.m. and at any adjourned date to give testimony in this action on the part of the defendants, as a third-party witness, and that you bring with you the documents and other tangible things (as those terms are defined the New York Civil Practice Law and Rules, Rule 3120) described in Schedule A annexed hereto, now in your possession, custody or control, and produce them at the same time and place as you have been directed to appear for your examination.

           Your failure to comply with this subpoena is punishable by contempt and shall make you liable to the person on whose behalf the subpoena has been issued for a penalty not to exceed $50.00 and all damages sustained by reason of your failure to comply.
